Terms and conditions

1. Scope

These terms and conditions apply to all orders placed through the Aurelia Botanics online shop.

The provider is:

Sales and delivery currently take place exclusively within Switzerland.

2. Offer and conclusion of contract

The presentation of the products in the online shop provides information about the Aurelia Botanics range and does not yet constitute a binding offer.

Before completing the order, the customer can review and correct the selected products and the details entered.

A binding order is placed by pressing the correspondingly marked order button.

Receipt of the order is confirmed electronically without delay.

Aurelia Botanics may refuse an order. This applies in particular if a product is unavailable, if prices are obviously incorrect, or if misuse is reasonably suspected.

Payments already made for an order that is not fulfilled will be refunded.

3. Products and natural variation

Aurelia Botanics offers cosmetic care products made with selected natural and plant-based raw materials.

With natural raw materials, slight differences may occur depending on origin, harvest and batch, particularly in colour, natural inherent scent, consistency or appearance.

Such natural variation does not constitute a product defect, provided the safety, quality and intended use of the product are not impaired.

The details and ingredients of the product actually delivered shall prevail.

4. Prices and VAT

All prices are stated in Swiss francs (CHF).

Aurelia Botanics is currently not liable for VAT. The prices stated are final prices.

Additional shipping costs are shown separately and transparently before the order is completed.

5. Payment options

The payment methods currently available are shown during the ordering process.

Depending on the payment method chosen, payment may be processed by external payment service providers. The respective terms and privacy policies of the provider concerned additionally apply to their services and data processing.

6. Delivery and shipping

Aurelia Botanics currently delivers exclusively to delivery addresses within Switzerland.

Delivery abroad is currently not offered.

The applicable shipping costs and the expected delivery time are shown in the online shop before the order is completed.

Stated delivery times are indicative only unless a binding delivery date has been expressly agreed.

If an ordered product cannot be delivered, Aurelia Botanics will inform the customer. Payments already made for products not delivered will be refunded.

7. No voluntary return, no right of withdrawal and no exchange

Aurelia Botanics does not grant any voluntary right of return, withdrawal or exchange.

Products that were ordered properly, are free of defects and were delivered correctly will not be taken back or exchanged.

This also applies to unopened and unused products.

A refund on the grounds of dislike, a change of mind or a mistaken product selection by the customer is not offered.

Statutory claims in the case of defective, damaged or incorrectly delivered goods remain expressly unaffected.

8. Returns

Products should not be returned without first contacting Aurelia Botanics and agreeing the return.

An unsolicited return of defect-free and correctly delivered goods does not give rise to any claim to a refund or exchange.

In the case of a justified complaint, Aurelia Botanics will advise on how to proceed after examination.

9. Defects, damage and incorrect deliveries

The customer should check the goods on receipt.

In the case of damaged, defective or incorrectly delivered goods, Aurelia Botanics should be contacted at info@aureliabotanics.ch as promptly as possible after discovery.

To allow prompt processing, the following information should be provided where possible:

• order number
• a short description of the problem
• for visible defects or damage, suitable photographs of the product and, where applicable, of the shipping packaging

After examining the complaint, Aurelia Botanics will advise on how to proceed.

Depending on the nature of the defect and the statutory requirements, replacement, rectification or another remedy provided for by law may in particular be considered.

10. Warranty

The applicable provisions of Swiss law apply to defects.

Mandatory statutory claims of customers are reserved.

The statutory limitation period for claims for defects in new goods is generally two years from delivery. Mandatory statutory minimum periods remain unaffected.

11. Product information and use

Aurelia Botanics products are cosmetic products and are intended in principle for external use, unless expressly stated otherwise for the product concerned.

Before use, please observe in particular the ingredient details and the instructions for use, storage and safety on the relevant packaging and product page.

Natural and plant-based ingredients can also cause individual intolerances or allergic reactions.

In the case of known allergies or hypersensitivities, the ingredients should be checked carefully before use.

With sensitive skin, a new product can first be tested on a small area of skin.

In the event of undesirable reactions, use should be discontinued. In the case of persistent or more severe symptoms, professional medical advice should be sought.

12. Cosmetic product information

The product information provided on the website serves to describe the cosmetic properties, care and use of the products.

Aurelia Botanics products are not intended to diagnose, treat or cure illness and are not a substitute for medical advice.

13. Liability

Aurelia Botanics is liable within the scope of mandatory statutory provisions.

To the extent permitted by law, liability is excluded for damage demonstrably caused by improper use. The same applies to damage caused by failure to observe the instructions for use or safety information provided, or by use outside the intended purpose.

Mandatory statutory claims, in particular in connection with product safety and mandatory liability provisions, remain unaffected.

14. Data protection

Information on the processing of personal data can be found in the separate Aurelia Botanics privacy policy.

The privacy policy is available at any time via the website.

15. Changes to these terms

Aurelia Botanics may amend or supplement these terms and conditions for future orders.

The version of the terms and conditions available at the time the contract was concluded applies to each order.

Subsequent changes have no retroactive effect on contracts already concluded.

16. Applicable law and place of jurisdiction

Swiss law applies to the contractual relationship.

Mandatory statutory places of jurisdiction, in particular those protecting consumers, are reserved.
